Legal secrecy versus the duty of disclosure

The Patent and Market Court stated in case PMT 20357-20 that only extremely modest evidence is required for a document to be considered related to the lawyer's assignment towards the client and thus to be covered by the lawyer's obligation of confidentiality (see  NJA 2010 p.122). It can thus, once again, be stated that the lawyer's obligation of confidentiality and the client's right to secrecy have a very high status and a high protection value in Swedish law and that the duty to publish is the interest that may give way in the event of a conflict.
