Supreme Court on provisions extinguishing legal rights in standard-form contracts

The Swedish Supreme Court confirms that statutory and contractual provisions prescribing how and within what time a claim must be asserted in order to avoid forfeiture must be interpreted restrictively, and should not be applied by analogy, particularly where the legal consequence of non-compliance is not expressly stated. In this case, a party was not deemed to have forfeited its right to damages despite having submitted the claim late. Read more in the article here!
