How to mitigate the costs in arbitration and disputes

Lund's Judicial Academy, the Southern Sweden Chamber of Commerce, and the SCC Arbitration Institute organized the Arbitration Day in Lund on November 27, 2024, where the reasons for the increased legal costs in disputes in Sweden and the measures that lawyers and arbitrators can take to limit these costs were discussed. Arbitrators, lawyers, counsels, and judges gathered at the Grand Hotel in Lund. Why do not the parties agree on legal costs in the arbitration clauses? Could the SCC's combination clause be combined with a mediation clause? Could the arbitrator limit the legal costs in the procedure orders and in what way? Which dispute resolution tools are available for the parties? Could the parties agree on a cap where the losing party in a dispute has to cover the winning party's legal costs up to a certain amount? Lina Bergkvist participated in a panel to discuss the lawyer's role in limiting costs in arbitration and how the arbitration clause can be formulated to limit the risk.
