Contractual Penalties and Damages

On September 19, 2024, Zellberg held a successful seminar for corporate lawyers on the theme "Contractual Penalties and Damages - When should we use what and can sanctions be used cumulatively?" Questions such as how to prepare your organization for delays and how to think about liability issues regarding damages, were discussed lively. Everyone participated in the discussions and contributed with their experiences from their respective industries. In summary, we can conclude that contractual penalties can be combined with damage clauses, penalties have a preventive and predictable effect that cannot be achieved with damages, and it is of utmost importance to limit damages, at least if the damage also includes other than just direct damages.
